Terms of Service

1. Acceptance of Terms
By accessing or using the KonbiniAPI service, including the API, website, dashboard, and documentation available at konbiniapi.com, app.konbiniapi.com, docs.konbiniapi.com, and api.konbiniapi.com (collectively, the “Service”), you agree to be bound by these Terms of Service (“Terms”).
If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms. If you do not agree, do not use the Service.
2. Description of Service
KonbiniAPI provides a RESTful API that retrieves publicly available data from social media platforms, currently Instagram and TikTok. The data is fetched in real time and normalized into a consistent format based on the ActivityStreams 2.0 specification.
The Service includes profile information, posts, comments, highlights, stories, and other publicly accessible content. We do not store, cache, or index social media data beyond what is necessary to fulfill an individual API request.
Available endpoints, response formats, and supported platforms may change over time. We document the current state of the API at docs.konbiniapi.com.
3. Account Requirements
To use the Service, you must:
- Be at least 18 years old.
- Provide accurate and complete information when creating your account.
- Maintain only one account per person or organization.
- Keep your API key confidential. You are responsible for all activity under your account, whether authorized by you or not.
If we discover duplicate accounts, we may merge or terminate them at our discretion.
4. API Usage License
Subject to these Terms, KonbiniAPI grants you a limited, non-exclusive, non-transferable, revocable license to access and use the API for your internal business purposes or personal projects.
This license does not permit you to sublicense, redistribute, or provide direct access to the API to third parties. You may, however, use data retrieved through the API within your own applications and services.
5. Credits and Billing
The Service operates on a monthly subscription model. Each plan includes a fixed number of credits per billing cycle. One credit equals one successful API request.
Key billing details:
- All payments are processed through Stripe. By subscribing, you also agree to Stripe's Terms of Service.
- Credits do not roll over. Unused credits expire at the end of each billing cycle.
- Failed requests, timed-out requests, and requests that return an error do not consume credits. You are only charged for successful responses.
- When your credits are exhausted, the API returns a 402 status code. There are no automatic overage charges.
- Plan upgrades take effect immediately. Downgrades take effect at the start of the next billing cycle.
6. Refund Policy
We do not offer refunds for credits that have already been used.
If you purchased a plan and have not consumed any credits, you may request a pro-rated refund within 48 hours of the charge by emailing hello@konbiniapi.com. After 48 hours, or once any credits have been used, the charge is final.
7. Acceptable Use
You agree not to use the Service to:
- Engage in or facilitate any illegal activity under applicable law.
- Harass, stalk, monitor, or surveil individuals without their knowledge or consent.
- Generate fake engagement, create inauthentic interactions, or manipulate platform metrics.
- Violate the privacy of individuals, including by compiling personal data profiles for purposes that the data subjects would not reasonably expect.
- Build a product or service that replicates or directly competes with KonbiniAPI's core offering (a social media data API).
- Attempt to access non-public data, circumvent security measures, or exceed the scope of authorized access.
- Resell or redistribute raw API responses without meaningful transformation or value addition.
- Use automated means to create accounts, generate API keys, or circumvent credit limits.
Violation of this section may result in immediate suspension or termination of your account without prior notice.
8. Data and Public Information
KonbiniAPI exclusively accesses data that is publicly available on the supported social media platforms. We do not bypass authentication mechanisms, use stolen credentials, or access private or restricted content.
Under the EU General Data Protection Regulation (GDPR), the processing of publicly available personal data may be lawful under Article 6(1)(f) where there is a legitimate interest. Recital 47 of the GDPR recognizes that legitimate interests may include processing for direct marketing, fraud prevention, network security, and other purposes where the data subject's interests or fundamental rights do not override. In accordance with Article 14, where personal data has not been obtained directly from the data subject, appropriate transparency obligations apply.
You are solely responsible for how you use data obtained through the Service. You must ensure that your use of the data complies with all applicable data protection laws, including but not limited to the GDPR, the UK Data Protection Act 2018, the California Consumer Privacy Act (CCPA), and any other relevant legislation in your jurisdiction.
If you process personal data retrieved through the API, you are the data controller for that processing. You are responsible for maintaining a lawful basis, responding to data subject requests, and fulfilling any applicable transparency obligations.
9. Intellectual Property
The API, its documentation, the KonbiniAPI website, the dashboard, and all associated software, design, and branding are the intellectual property of KonbiniAPI and its operator. These Terms do not grant you any ownership rights in the Service.
Data returned through the API originates from third-party social media platforms and their users. We do not claim ownership of that data. The intellectual property rights in the underlying content belong to the respective platforms and content creators.
You retain ownership of your own applications, products, and services built using the API.
10. Service Availability
We work to keep the Service running reliably, but we do not guarantee any specific uptime percentage or service level. The Service is provided on an “as is” and “as available” basis.
Social media platforms may change their interfaces, restrict access, or block certain data at any time and without warning. As a result, individual API endpoints may become temporarily or permanently unavailable. We will do our best to communicate known disruptions, but we cannot guarantee advance notice.
We may modify, deprecate, or discontinue endpoints with reasonable notice. Where possible, we will provide at least 7 days' notice before removing an endpoint.
11. Termination
You may cancel your subscription and close your account at any time through the dashboard or by emailing hello@konbiniapi.com. Cancellation takes effect at the end of the current billing cycle. You will retain access to the Service until then.
KonbiniAPI may suspend or terminate your account immediately and without prior notice if you violate these Terms, engage in abusive behavior, or if we reasonably believe your use of the Service poses a risk to the Service or to third parties.
Upon termination, any unused credits are forfeited and are not eligible for refund. Your API key will be revoked and all pending requests will be rejected.
12. Limitation of Liability
To the maximum extent permitted by applicable law, KonbiniAPI and its operator shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the Service. This includes, but is not limited to, loss of profits, loss of data, business interruption, and reputational damage.
Our total aggregate liability for any claims arising under or related to these Terms shall not exceed the total amount of fees you have paid to KonbiniAPI during the twelve (12) months immediately preceding the event giving rise to the claim.
We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to natural disasters, war, terrorism, labor disputes, government actions, internet service failures, third-party platform changes, or other force majeure events.
13. Indemnification
You agree to indemnify, defend, and hold harmless KonbiniAPI, its operator, and its affiliates from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to:
- Your use or misuse of the Service.
- Your violation of these Terms.
- Your processing or handling of data obtained through the API.
- Any third-party claim related to your applications, products, or services that use the API.
14. Governing Law
These Terms are governed by and construed in accordance with the laws of Spain. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Spain.
If you are a consumer based in the European Union, nothing in these Terms affects your rights under mandatory consumer protection laws in your country of residence.
15. Changes to Terms
We may update these Terms from time to time. When we make material changes, we will notify you at least 14 days in advance via email to the address associated with your account.
Your continued use of the Service after the updated Terms take effect constitutes your acceptance of the changes. If you do not agree with the revised Terms, you should stop using the Service and cancel your subscription before the changes take effect.
